The Ooty home stay rules decide if a house can host paying guests. The main point is simple. A permit to build a house is not a permit to run a tourist stay. Say you buy a stone cottage above the town. The listing sells it as a homestay in Ooty, and it looks great. The caretaker says weekends are always full. You pay. A few weeks later, officials come and put a seal on the door.

You need two approvals, not one

A building used for business needs two approvals. First, it needs a yes from a district-level committee that checks business building licences. Then it needs a yes from the Hill Area Conservation Authority in Chennai. A house permit gives you neither.

How houses turned into cottages

Officials say this happened slowly. Many owners got permission to build a house. Later, they turned it into a tourist cottage. Some of the home stays in Ooty today began as plain house permits. Neighbours noticed. Social groups and green activists complained. Then the town office acted.

How the Ooty Home Stay Rules Started Being Enforced

The push to enforce the Ooty home stay rules began in a court, not in a government office.

The court steps in

Lawyers told the Madras High Court that some homestays were charging guests too much. The court asked the Nilgiris and Dindigul districts to form a three-member team, led by the District Revenue Officer, to check homestays with no licence. Kodaikanal is in Dindigul. A special committee was formed on 25 July 2025. It had the revenue officer, the municipal commissioner, the district tourism officer and local officials. By September 2025, the district administration had sealed 25 illegal homestays that had no valid licence. The Collector said the work would go on.

Why Ooty cottages are being sealed now

For a long time, things moved slowly. Then more complaints came in. Officials began walking through the wards to find houses that had quietly turned into cottages. In the first round, they sealed six illegal tourist cottages. Activists want every cottage, homestay and guest house without permission to be found. Owners cannot expect quick help from the courts. In April 2026, the Madras High Court refused to stop the sealing of two Ooty homestays. It told the owners to take their complaints to the special bench that had ordered the action, according to DT Next.

Ask the simple questions first

Think back to that morning with the seal. Before paying, you could have asked the seller for the first building permission and checked what use it allows. You could have asked if the district committee and the Hill Area Conservation Authority approved it for business use. You could have asked if it has a homestay licence and if any notice has come. The income that can disappear

Rental income is only as safe as the permission behind it. Nightly prices and booking claims for home stays in Ooty are just sales talk until the papers prove them. A cottage with the right approvals may cost more. But you pay for income that can pass an inspection.

Stricter homestay rules are spreading across hill stations. Himachal Pradesh brought in its own Homestay Rules, 2025, after hotel associations said many homestays were running illegally. The rules are tougher and the fees are higher. A unit with four to six rooms in a municipal area pays ₹12,000. A unit with one to three rooms pays ₹8,000.

Shared ownership has the same question

Fractional and co-ownership, where a few people share one property, is a growing way to buy into hill towns. The same test applies. Ask who holds the permission to host guests, and for which units.

The Ooty home stay rules are not new, but the enforcement is. Check the papers before you fall for the view.
